Copyright and DMCA Policy

Estanislao Fusion respects copyright and expects its customers to do the same. Customers warrant that they hold the rights to everything they upload, including music. If you believe material published through Hookshift infringes your copyright, this page tells you how to say so and what we will do.

1. How to send a notice of infringement

Send a written notice to the designated agent below. To be effective, it must include all of the following:

  1. A physical or electronic signature of the copyright owner, or of a person authorised to act for them.
  2. Identification of the copyrighted work you say has been infringed. If several works are covered by a single notice, a representative list of them.
  3. Identification of the material you say is infringing, with enough detail for us to locate it. A URL is best.
  4. Your contact details: name, postal address, telephone number and email address.
  5. A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on their behalf.

Notices sent anywhere other than this address may not be acted on.

A caution required by law: anyone who knowingly makes a material misrepresentation that material is infringing may be liable for damages, including costs and legal fees, under 17 U.S.C. section 512(f).

2. What we do with a notice

On receiving a valid notice we will remove or disable access to the material, tell the customer who uploaded it, and pass on your notice. Where the material has been published to the customer's Instagram account, we will also disable the customer's ability to republish it through Hookshift. Removing something from an Instagram account is a separate step that only the account owner or Instagram can take, and we will tell you if that is the situation.

3. Counter-notice

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the agent above containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed, and where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, postal address, telephone number and email address.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, of any judicial district in which we may be found, and that you will accept service of process from the person who sent the original notice or their agent.

We will forward your counter-notice to the complainant. If they do not tell us within 10 business days that they have filed an action seeking a court order, we may restore the material.

4. Repeat infringers

Accounts that are the subject of repeated valid infringement notices will be terminated. We keep a record of notices for this purpose.

5. Trademark and other complaints

For trademark complaints or other intellectual property concerns that are not copyright, write to support@hookshift.co with a description of the right you hold and the material concerned.
